I am new to this. My father has pushed me (only child) and all his siblings away for years. He has declined tremendously over the past 6 months and has asked me to get him into Assisted Living. He has wracked up a tremendous amount of debt that I know needs to be paid off. His pension and SS will be enough to cover Assisted Living. But if I budget his debt then I cannot afford a decent place for him. I feel stuck and know time of of the essence. He is going blind, had Diabetes, Possible return of cancer (will know soon), a fall risk due to neuropothy and incontinence. Any information would be greatly appreciated. He has a neighbor helping him at home, but she isn't a nurse.

Are you his POA? I would recommend a bankruptcy if his pension and his SS are enough for his ALF (must be some pension, because you are looking at approx 5,000 per mo. with care plan. I agree with others that he well may not qualify for the ALF, so that may be something to check out first.
I know that the creditors cannot collect against his SS even with court action, but am uncertain if that holds true for the pension.

Thank you for the response. I do have POA. There is an ALF about 30 mins from me that he can afford with his income but it’s almost all the pension and SS. I’ll definitely see if we can protect the pension...it was passed to him when my Step-mom died.

He may have to file for bankruptcy to get rid of the outstanding debt. That will then be one less thing you have to worry about and he can get the care he needs. Good luck.

Thank you..yes I agree we need to do the bankruptcy. I am quite concerned about how long it could take. He is going down hill quickly and I worry about his safety at home.

Sounds like he needs more than an AL. May be easier to get him on Medicaid with his SS and pension going for his care. His SS cannot be garnished. Then maybe you can declare bankruptcy. You may want to talk to an elder lawyer well versed in Medicaid.

Thank you, I think you’re right, I am going to look into an elder lawyer. He has good insurance and Medicare but getting the Medicaid is essential as well
